Terms of Service
In short: DigiTogether is for parents and guardians, to use with their own children on phones they're responsible for. Tell your child the app is on their phone. DigiTogether helps families, but it can't promise to block everything or to catch every risk, and SOS is not an emergency service: in an emergency, call 112. You can stop using the app and delete your family's data at any time.
1. Who we are and these terms
DigiTogether (the "App") is provided by Kundan Kumar, trading as DigiTogether, Bengaluru, Karnataka, India ("we", "us"). These terms are an agreement between us and you, the parent or guardian who creates a DigiTogether account. By creating an account or using the App you accept these terms and our Privacy Policy, which explains what data the App collects and how it's used.
2. Who can use DigiTogether
- You must be 18 or older and the parent or legal guardian of each child you add.
- A child uses DigiTogether only on a phone their parent or guardian has set up, through the parent's account. Children don't create accounts of their own.
- You may set up DigiTogether only on phones that you own or are responsible for, used by your own child. You must not use it to watch another adult, or someone else's child, without their knowledge and the legal right to do so.
3. Your responsibilities as a parent
- Tell your child that DigiTogether is on their phone and what it does. The App also shows this on the child's phone: a notification that stays while it runs, and a screen before each sensitive permission.
- Choose rules that suit your child's age and needs, and talk with them about them. DigiTogether is built to grow trust between you, not to replace it.
- Keep your account password and the child's PIN private. You are responsible for what happens with your account.
- Give accurate information, such as your child's name and age band, so the App works as expected.
4. What DigiTogether does, and what it can't promise
DigiTogether lets you set screen-time limits and app rules, see your child's activity and location, receive safety alerts, give quests and rewards, chat with your child, and receive an SOS when your child holds the SOS button.
- The App depends on the phone, its settings and permissions, the internet and push notifications. A phone that's off, offline, out of battery, or has a permission switched off may block nothing, send nothing or send late.
- No filter or monitoring tool is perfect. DigiTogether can't guarantee that it blocks every app, website or piece of content, or that it detects every risk. Safety alerts are automatic and can be wrong.
- SOS and family chat are not emergency services. An SOS reaches you only if both phones can connect. In an emergency, call 112 (India) or your local emergency number. Children can always use the phone's own dialler: DigiTogether never blocks it.
- We work to keep DigiTogether available but can't promise it will always be uninterrupted or error-free. We may change, add or remove features.
5. Acceptable use
You agree not to:
- use DigiTogether for anything unlawful, or to harass, stalk or harm anyone;
- install it on a phone you're not entitled to manage (see section 2);
- send unlawful, abusive or harmful content through family chat, notes or voice notes;
- try to get around the App's security, reach other families' data, copy or reverse-engineer the App, or overload our servers.
6. Your content
Messages, notes, voice notes and quest photos, voice notes or videos you or your child create stay yours. You give us permission to store, process and show them only as needed to run DigiTogether for your family, as described in the Privacy Policy. We delete them as that policy says, or when you delete them or your account.
7. Paid features
Some features may need a paid subscription. If so, the price and what you get are shown in the App before you buy. Payments are handled by Google Play: subscriptions renew until you cancel them in Google Play, and refunds follow Google Play's refund policies and the law that applies to you.
8. Ending your use
- You can stop using DigiTogether at any time. You can remove one child, or delete your whole account and all of your family's data, from the App. See Delete your account.
- We may suspend or close an account that seriously or repeatedly breaks these terms, or where the law requires it. Where we reasonably can, we will tell you first and explain why.
9. Disclaimers and liability
- DigiTogether is provided "as is" and "as available". To the extent the law allows, we make no promises beyond those in these terms.
- To the extent the law allows, we are not liable for indirect or consequential losses, or for harm that DigiTogether didn't prevent because of the limits described in section 4. Our total liability for any claim is limited to the amount you paid us for DigiTogether in the 12 months before the claim.
- Nothing in these terms limits any liability that can't be limited by law, or your rights as a consumer, including under India's Consumer Protection Act, 2019.
10. Changes to these terms
We may update these terms when DigiTogether or the law changes, and will change the "Last updated" date above. If a change is significant, we will tell you in the App before it takes effect. If you keep using DigiTogether after a change takes effect, the new terms apply; if you don't agree, you can delete your account.
11. Law and disputes
These terms are governed by the laws of India. Please contact us first so we can try to solve any problem. If we can't, the courts of Bengaluru, Karnataka, have jurisdiction, without taking away any right you have to go to a consumer forum or court where you live.
